One of the most common fears of couples in divorce revolves around money. ?It is entirely reasonable for divorcing spouses to worry if they will be able to survive financially after the split. ?For one thing, many residents?are terrified by the thought that they might find themselves paying their mortgage and marital debts alone.
However, following some simple measures provided by the law can ensure fairness in not only property allocation but also debt division.
The Basics
Marriage is like any other legally enforced agreement whose purpose is to create a union between two people. It results in a change of their status into husband and wife, giving rise to new rights and obligations to both spouses. The union is terminated by a demand for divorce, where the assets and liabilities are to be divided between the parties.
The law in Florida distinguishes marital assets and liabilities from non-marital assets and liabilities. When two people are married there is a presumption that all their property and debt are common. Marital liabilities are those incurred during the marriage, individually by either spouse or jointly by them. ?This presumption still applies in a proceeding for dissolution of marriage, where the court begins with the premise that all marital liabilities will be equitably divided between spouses.
Exceptions to Splitting Everything Equally
However, some categories of liabilities will escape this presumption, making each spouse individually responsible for non-marital debts incurred either prior to or during the marriage.
Also one spouse can also reverse the presumption of equitable distribution of debt by bringing evidence of the intentional waste or destruction of marital assets by the other spouse, unequal economic circumstances, or other reasons to be evaluated by the court.
1. Exclusion of one spouse?s individual debt from the division
In divorce, the court will not only set apart to each spouse that spouse?s non-marital assets but also certain liabilities?that is, one spouse will not be held accountable for the debts of the other. Individual debt that will not be considered in the division include:
? Any liabilities incurred by one spouse prior to the marriage (e.g., educational loan or business loans)
? Any liabilities excluded from marital assets by valid written agreement of the parties (prenuptial agreements)
2. Unequal distribution of debt determined by the court based on certain factors.
Upon dissolution of the marriage, the court may also effectuate an unequal distribution of marital liabilities based on relevant factors of contribution to the marriage by each spouse including:
? The economic circumstances of the spouses
? The duration of the marriage
? Any interruption of personal careers or educational opportunities of either spouse
? The contribution of one spouse to the personal career or educational opportunity of the other spouse
? The desirability of retaining the marital home as a residence for any dependent child of the marriage when it is equitable to do so and is in the best interest of the child
? The intentional ?dissipation, waste, depletion, or destruction? of marital assets by one spouse after the filing of the petition for divorce or within 2 years prior to the filing of the petition

Union negotiators and management came to a tentative agreement on a new contract for employees at the Pilgrim nuclear station power plant early today.
Plant owner Entergy Corp. had staffed the 685-megawatt plant with replacement workers during a two-week lockout after the contract with Utility Workers Union of America Local 369 expired June 6. The two sides had been at odds over minimum staffing levels and employee health benefits.
?We have finally emerged with an agreement that has important protections for the hardworking men and women who safely operate this 40-year-old nuclear power plant on a daily basis,? Local 369 President Dan Hurley said in a statement released this morning. The full membership of 240 employees will vote on the contract Wednesday. Details of the contract were not disclosed by the two sides.
?We appreciate the hard work of both parties to get to this point and believe this proposal represents fair and equitable terms both for our employees and the company,? site Vice President Robert Smith said. Elected officials including Senate President Therese Murray, D-Plymouth, had criticized Entergy for running the plant with replacements and questioned whether residents? safety was being jeopardized.
The Nuclear Regulatory Commission approved a 20-year renewal of the plant?s operating license on May 25. Attorney General Martha Coakley announced Monday she is appealing the decision, in part because the NRC failed to consider safety issues raised by the Fukushima nuclear disaster in Japan. Both plants use the same type of reactor.

ATHENS, Greece (AP) ? Greece's two pro-bailout parties appeared likely Monday to agree on forming a coalition government after a bruising election watched closely because of its potential impact on the world economy, but negotiations were pushed to a second day after the head of the socialist party insisted on a broad partnership.
Sunday's vote ? the second national election in six weeks ? again left no party with enough votes to form a government on its own. Antonis Samaras' conservative New Democracy party won the most seats in parliament and was leading efforts to forge a coalition.
The socialist PASOK party, led by former finance minister Evangelos Venizelos, came in third. But its 33 seats in the 300-member Parliament means it can form a government with New Democracy, which gained 129 seats. A coalition would have to have a minimum of 151 seats combined in order to form a government.
Both PASOK and New Democracy have said they will stick to Greece's international bailout commitments, although they want to renegotiate some of the harsh austerity measures imposed in return for the international rescue loans that have kept the country afloat since May 2010.
The election results eased concern that Greece faced an imminent exit from Europe's joint currency. A Greek exit from the 17-nation eurozone would have potentially catastrophic consequences for other ailing European nations and hurt the United States and the entire global economy.
As head of the party that came first, Samaras was given the mandate Monday to seek coalition partners. He has three days to reach an agreement, and if he fails the second party is given another three days to try. The radical left-wing anti-bailout Syriza party came in second.
"With Mr. Venizlos we agreed that within the deadline of my mandate ... a government of national salvation must absolutely have been formed," Samaras said after talks with the socialist leader. "We will of course have new meetings."
Samaras also met Monday evening with Fotis Kouvelis, the head of the small Democratic Left party that finished sixth in Sunday's vote. He said afterwards that the meeting was fruitful, and would be repeated Tuesday.
Kouvelis' party had been seen as a potential partner for PASOK and New Democracy after inconclusive elections on May 6. Those coalition talks collapsed after 10 days of wrangling, triggering last Sunday's elections.
Syriza has refused to join the other two parties in a government, saying it will not cooperate with any group that insists on implementing the harsh austerity measures taken in return for Greece's two international bailout agreements.
Venizelos, however, has insisted on a broad coalition. "The most crucial thing for us right now is to achieve the greatest possible range of consensus, and this must happen by tomorrow night at the latest," he said after his talks with Samaras.
He also criticized Syriza chief Alexis Tsipras for his refusal to join in governing Greece. "You can't have some people choosing the easy position of being in opposition and lying in wait for the government to fail ? or rather trying to create the conditions for the government, that is the country, to fail," Venizelos said.
On the streets of Athens, the mood was mixed, with many saying party leaders must get their act together.
"The election result isn't strong enough to put people's minds at ease," said sandwich shop owner Mary Moutafidis, 57. "They still have to agree to form a government."
European Union leaders appeared relieved that a pro-austerity government had a good chance of being formed.
"Continued fiscal and structural reforms are Greece's best guarantee to overcome the current economic and social challenges," European Council President Herman Van Rompuy and European Commission President Jose Manuel Barroso said in a joint statement.
But an early market rally faded quickly Monday as investors turned their attention back to the other financially unstable economies in the Eurozone, Spain and Italy.
In Athens, stocks lost initial strong gains but still closed up 3.64 percent.
Greece has survived for more than two years on rescue loans from its European partners and the International Monetary Fund. The vital bailouts are conditional on the country continuing with its deeply unpopular package of spending cuts, and pushing through new structural reforms.
Athens has pledged to push through new savings worth nearly ?15 billion ($18.9 billion), raise billions in company and real estate privatizations and sack about 150,000 civil servants.
Both New Democracy and PASOK want an extension of at least two years to the austerity and reform deadline, to alleviate pressure on a population exhausted by two-and-a-half years of deep income cuts and tax hikes.
Unemployment has soared to more than 22 percent, while Greece's economy is in a fifth year of deep recession.

WASHINGTON (AP) ? After a decade of costly conflict in Iraq and Afghanistan, the American way of war is evolving toward less brawn, more guile.
Drone aircraft spy on and attack terrorists with no pilot in harm's way. Small teams of special operations troops quietly train and advise foreign forces. Viruses sent from computers to foreign networks strike silently, with no American fingerprint.
It's war in the shadows, with the U.S. public largely in the dark.
In Pakistan, armed drones, not U.S. ground troops or B-52 bombers, are hunting down al-Qaida terrorists, and a CIA-run raid of Osama bin Laden's hide-out was executed by a stealthy team of Navy SEALs.
In Yemen, drones and several dozen U.S. military advisers are trying to help the government tip the balance against an al-Qaida offshoot that harbors hopes of one day attacking the U.S. homeland.
In Somalia, the Horn of Africa country that has not had a fully functioning government since 1991, President Barack Obama secretly has authorized two drone strikes and two commando raids against terrorists.
In Iran, surveillance drones have kept an eye on nuclear activities while a computer attack reportedly has infected its nuclear enrichment facilities with a virus, possibly delaying the day when the U.S. or Israel might feel compelled to drop real bombs on Iran and risk a wider war in the Middle East.
The high-tech warfare allows Obama to target what the administration sees as the greatest threats to U.S. security, without the cost and liabilities of sending a swarm of ground troops to capture territory; some of them almost certainly would come home maimed or dead.
But it also raises questions about accountability and the implications for international norms regarding the use of force outside of traditional armed conflict. The White House took an incremental step Friday toward greater openness about the basic dimensions of its shadowy wars by telling Congress for the first time that the U.S. military has been launching lethal attacks on terrorist targets in Somalia and Yemen. It did not mention drones, and its admission did not apply to CIA operations.
"Congressional oversight of these operations appears to be cursory and insufficient," said Steven Aftergood, an expert on government secrecy issues for the Federation of American Scientists, a private group.
"It is Congress' responsibility to declare war under the Constitution, but instead it appears to have adopted a largely passive role while the executive takes the initiative in war fighting," Aftergood said in an interview.
That's partly because lawmakers relinquished their authority by passing a law just after the Sept. 11 terrorist attacks that essentially granted the White House open-ended authority for armed action against al-Qaida.
Secret wars are not new.
For decades, the CIA has carried out covert operations abroad at the president's direction and with congressional notice. It armed the mujahedeen in Afghanistan who fought Soviet occupiers in the 1980s, for example. In recent years the U.S. military's secretive commando units have operated more widely, even in countries where the U.S. is not at war, and that's blurred the lines between the intelligence and military spheres.
In this shroud of secrecy, leaks to the news media of classified details about certain covert operations have led to charges that the White House orchestrated the revelations to bolster Obama's national security credentials and thereby improve his re-election chances. The White House has denied the accusations.
The leaks exposed details of U.S. computer virus attacks on Iran's nuclear program, the foiling of an al-Qaida bomb plot targeting U.S. aircraft, and other secret operations.
Two U.S. attorneys are heading separate FBI investigations into leaks of national security information, and Congress is conducting its own probe.
It's not just the news media that has pressed the administration for information about its shadowy wars.
Some in Congress, particularly those lawmakers most skeptical of the need for U.S. foreign interventions, are objecting to the administration's drone wars. They are demanding a fuller explanation of how, for example, drone strikes are authorized and executed in cases in which the identity of the targeted terrorist is not confirmed.
"Our drone campaigns already have virtually no transparency, accountability or oversight," Rep. Dennis Kucinich, D-Ohio, and 25 other mostly anti-war members of Congress wrote Obama on Tuesday.
A few dozen lawmakers are briefed on the CIA's covert action and clandestine military activity, and some may ask to review drone strike video and be granted access to after-action reports on strikes and other clandestine actions. But until two months ago, the administration had not formally confirmed in public its use of armed drones.
In an April speech in Washington, Obama's counterterrorism chief, John Brennan, acknowledged that despite presidential assurances of a judicious use of force against terrorists, some still question the legality of drone strikes.
"So let me say it as simply as I can: Yes, in full accordance with the law ? and in order to prevent terrorist attacks on the United States and to save American lives ? the United States government conducts targeted strikes against specific al-Qaida terrorists, sometimes using remotely piloted aircraft, often referred to publicly as drones," he said.
President George W. Bush authorized drone strikes in Pakistan and elsewhere, but Obama has vastly increased the numbers. According to Bill Roggio of The Long War Journal, an online publication that tracks U.S. counterterrorism operations, the U.S. under Obama has carried out an estimated 254 drone strikes in Pakistan alone. That compares with 47 strikes during the Bush administration.
In at least one case the target was an American. Anwar al-Awlaki, an al-Qaida leader, was killed in a U.S. drone strike in Yemen in September.
According to a White House list released late last year, U.S. counterterrorism operations have removed more than 30 terrorist leaders around the globe. They include al-Qaida in East Africa "planner" Saleh Ali Saleh Nabhan, who was killed in a helicopter strike in Somalia.
The drone campaign is highly unpopular overseas.
A Pew Research Center survey on the U.S. image abroad found that in 17 of 21 countries surveyed, more than half of the people disapproved of U.S. drone attacks targeting extremist leaders in such places as Pakistan, Yemen and Somalia. In the U.S., 62 percent approved of the drone campaign, making American public opinion the clear exception.
The U.S. use of cyberweapons, like viruses that sabotage computer networks or other high-tech tools that can invade computers and steal data, is even more closely shielded by official secrecy and, arguably, less well understood.
Sen. John McCain, R-Ariz., has been a leading critic of the administration's handling of information about using computers as a tool of war.
"I think that cyberattacks are one of the greatest threats that we face," McCain said in a recent interview, "and we have a very divided and not very well-informed Congress addressing it."
Defense Secretary Leon Panetta and national security officials often talk publicly about improving U.S. defenses against cyberattack, not only on U.S. government computer systems but also against defense contractors and other private networks linked, for example, to the U.S. financial system or electrical grid. Left largely unexplained is the U.S. capacity to use computer viruses and other cyberweapons against foreign targets.
In the view of some, the White House has cut Congress out of the loop, even in the realm of overt warfare.
Sen. James Webb, D-Va., who saw combat in Vietnam as a Marine, introduced legislation last month that would require that the president seek congressional approval before committing U.S. forces in civil conflicts, such as last year's armed intervention in Libya, in which there is no imminent security threat to the U.S.
"Year by year, skirmish by skirmish, the role of the Congress in determining where the U.S. military would operate, and when the awesome power of our weapon systems would be unleashed has diminished," Webb said.

NFL players and U.S. soldiers have been meeting to discuss concussions, and plan to get together frequently in the future.
Current players such as Arizona star receiver Larry Fitzgerald and Cleveland All-Pro tackle Joe Thomas met last Friday at the Pentagon with former players and coaches, league medical personnel and representatives from the U.S. Army and Marines. The NFL expects to have military members attend team training camps beginning in late July to further exchange ideas.
Players will attend military bases in the future to discuss concussions, as well.
The cooperation between players and soldiers was initiated from several trips Commissioner Roger Goodell has taken with military personnel.
Goodell met last fall with Gen. Raymond T. Odierno, Chief of Staff of the Army, and Gen. Peter W. Chiarelli, Army vice chief of staff. Odierno met with Goodell again last month to discuss progress in the diagnosis and treatment of concussions, head trauma and resultant illnesses.
On hand last Friday among the players were Fitzgerald, Thomas, Steelers safety Ryan Clark, who is a union player rep, and Falcons linebacker Sean Weatherspoon. Former players included receiver Derrick Mason, who retired this week as a Raven; centers Shaun O'Hara and Courtney Hall; running back Brian Westbrook; defensive linemen Hollis Thomas and Mike Rucker; running back Merril Hoge, who was forced to retire because of post-concussion syndrome.
Former Jets and Browns head coach Eric Mangini also attended, as did trainers for the Steelers, Ravens and Redskins.

However, they don't usually ask for this unless you've made it through the initial screening and are being considered for hire.

Nintendo broke a few hearts when it initially said the Wii U would only support one of its unique Gamepads. Much to our delight, the company just said in its live keynote that the final console will support two. As such, it'll be possible to have truly equal two-player games instead of relegating a friend to the old-fashioned Wii remote and Nunchuk. Of course, how much that extra Gamepad will cost we have yet to know -- along with whether or not it'll be possible to have strictly Gamepad-to-Gamepad titles that skip the TV entirely. We expect to find out soon.
Update: In a follow-up, Nintendo Japan has posted on Twitter that there's a price to pay if two Gamepads are active. Frame rates drop to about 30 fps if two are active; any games that really want that extra controller won't be quite as glass-smooth. On the upside, it's possible to switch one off with a smooth transition; there won't be a need for theatrics just to switch to a solo game.
